Scope
This policy applies to personal data collected through our website, contact forms, communications, proposals, and related digital services operated by Lumicade Solutions (Registration No.: JM1042046-K).
Information We Collect
Information you provide: name, email address, phone number, company details, and message content submitted via forms or correspondence.
Technical data: IP address, browser and device information, pages viewed, session duration, and interaction metadata.
Communication records: enquiries, quotations, support communications, and project-related correspondence.
Note: Lumicade Solutions does not collect biometric data (including fingerprints or facial recognition data) without explicit, separate consent as required under the amended PDPA.

Legal Basis and Purpose of Processing
Personal data is processed under the following lawful bases:
- Contractual necessity — to respond to enquiries and deliver requested services
- Legal obligation — to comply with Malaysian law, including the PDPA, tax legislation, and regulatory requirements
- Legitimate interests — to secure, monitor, and improve platforms and operations, subject to applicable legal safeguards
- Consent — where explicit consent has been given for a specific processing activity (consent may be withdrawn at any time, subject to legal or contractual limitations)
Disclosure of Information
Lumicade Solutions does not sell personal data.
Data may be disclosed to vetted service providers (for hosting, analytics, communications, and operations) under contractual confidentiality obligations.
Data may be disclosed where required by Malaysian law, court order, or regulatory direction, or to establish, exercise, or defend legal rights.
Any third-party data processors engaged by Lumicade are contractually bound to comply with the Security Principle under the amended PDPA, as data processors now carry direct statutory obligations under the PDPA (Amendment) Act 2024.
Data Breach Notification
In the event of a personal data breach that is likely to cause significant harm or affect a large number of data subjects, Lumicade Solutions will:
- Notify the Personal Data Protection Commissioner (PDPC) as soon as practicable (within 72 hours where feasible), in accordance with the PDPA (Amendment) Act 2024
- Notify affected individuals where the breach is likely to result in significant harm
- Maintain an internal record of all data breaches for regulatory compliance purposes
Data Protection Officer (DPO)
In accordance with the PDPA (Amendment) Act 2024 (effective June 2025), Lumicade Solutions has appointed or will appoint a Data Protection Officer (DPO) responsible for overseeing compliance with the PDPA. All data protection enquiries may be directed to:

Data Retention
Personal information is retained only for as long as necessary to fulfill the purposes described in this policy, including legal, regulatory, accounting, and dispute-resolution requirements. When data is no longer required, it is securely destroyed or anonymized in accordance with the PDPA Retention Principle.
Data Security
Reasonable administrative, technical, and organizational safeguards are implemented to protect personal data from unauthorized access, loss, misuse, or disclosure. In accordance with the PDPA (Amendment) Act 2024, both Lumicade as data controller and any engaged data processors are bound by the Security Principle. No internet transmission or storage method is fully secure, and absolute security cannot be guaranteed.

- Access — request access to personal data held about you
- Correction — request correction of inaccurate, incomplete, or outdated data
- Withdrawal of Consent — withdraw consent where processing is consent-based, subject to legal or contractual limitations

International Data Transfers

These Terms of Service (“Terms”) govern access to and use of Lumicade Solutions’ website and related digital services. By accessing or using the services, you agree to be bound by these Terms and all applicable Malaysian laws.
Eligibility and Acceptance
You represent that you are at least 18 years of age and have the legal capacity to enter into binding agreements under the Contracts Act 1950 (Malaysia). If you do not agree to these Terms, you must discontinue use of the services.
By using services electronically, you acknowledge that electronic contracts are legally valid and enforceable under the Electronic Commerce Act 2006 (Malaysia).
Services and Availability
Lumicade Solutions provides software engineering and related digital services. Service descriptions, timelines, scope, and deliverables are further specified in proposals, statements of work, or separate written agreements, which shall form part of the contractual relationship between the parties.
Lumicade Solutions may modify, suspend, or discontinue parts of the services where reasonably required for business, legal, security, or technical reasons, with reasonable notice where practicable.
Acceptable Use

- Engage in conduct that breaches applicable Malaysian laws, including the Contracts Act 1950, Consumer Protection Act 1999, and Electronic Commerce Act 2006
Consumer Protection
Where Lumicade’s services constitute a trade transaction under the Consumer Protection Act 1999 and the Electronic Commerce (Consumer Protection) Regulations 2012, Lumicade Solutions complies with applicable disclosure and consumer rights obligations for digital service providers in Malaysia.
Intellectual Property
Unless otherwise stated, all content, trademarks, designs, source code, documentation, and materials are owned by Lumicade Solutions or its licensors and are protected under applicable Malaysian intellectual property laws, including the Copyright Act 1987 and the Trade Marks Act 2019. No rights are granted except as expressly provided in writing.
Third-Party Services
The services may include links or integrations with third-party platforms. Lumicade Solutions is not responsible for third-party content, terms, privacy practices, or availability.
Disclaimers
To the fullest extent permitted by Malaysian law, the services are provided “as is” and “as available”without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non– infringement.
Limitation of Liability
To the fullest extent permitted by Malaysian law, Lumicade Solutions shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from the use of the services.
Nothing in this clause limits liability for death, personal injury, fraud, or any matter that cannot be excluded under Malaysian law, including the Consumer Protection Act 1999.
Indemnification
You agree to indemnify and hold harmless Lumicade Solutions, its directors, officers, and employees from any claims, liabilities, damages, and expenses (including legal fees) arising from your misuse of the services or breach of these Terms.
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Malaysia, unless otherwise required by applicable law or agreed in writing by both parties.
Changes to Terms
These Terms may be updated periodically. Material changes will be reflected by updating the date above. Continued use of the services after updates constitutes acceptance of the revised Terms, consistent with the Electronic Commerce Act 2006.
